Full Version: new to all this, question about first hearing

I am in New York. I was injured while restraining a client. I am having cervical spine surgery next week. Workers comp has authorized it. They have me at only partially disabled until the surgery and on the day of surgery will change to total. My attorney filed for a hearing since in the beginning they were refusing to pay anything, then drug their feet with the surgery. The letter says there is question sof accident, notice to employer and causal relationshi of accident to injury. I am confused, because I would think if they were questioning it, why are they authoriizing the surgery? The hearing was requested prior to them authorizing my sugery. Is it jutst a case of timing. I had a prior cervical spine injury in 2007, paid for by the same insurance company and now this one in 2009. I secured another job in my agency while out, it is one that does not require physical interventions with the clients. I am told by my doctor I might return two weeks after my surgery if doing well. All I want to do is return to work and be done with this. I am just asking why that information was put on the letter. If anyone can help I would appreciate it.

In my experience, the IC will deny everything that they can just to drag everything out. My boss had to take me to the hospital and the IC said "It did not happen at work". I would say don't worry about it.
thanks for the reponse. I just want this all over with. Like I said they are paying me a partial rate, which along with my AFLAC is ok They are paying for my surgery. If I am able to go back to work when expected, then I will keep my job. I am mostly worried about further medical issues that may arise and want to make sure they continue to pay for it.
