Full Version: confused and need help!

I was recently injured on my job. I went to the emergency room my back was hurting alot and I blacked out when I was injured. I left the emergency room with instructions to see the workforce Dr. before returning to work. I did see the workforce Dr. he took some x-rays and found arthritis in my lower back. I was to return to work on light duty. I got a phone call from my employer and they let me go. My workmans comp is still being reviewd . Any help would be appreciated . Thanks..

hang on TT....someone will be along to answer you. As WC is state specific rules.

I have a question though...what reason did your employment give you, for firing you? They cannot fire you simply because you were hurt. You are protected by FMLA for 3 months....THEN, they can be rid of you. You may need an EEOC lawyer.

once you are released from workers comp you can file for unemployment.
It's illegal to fire an employee for filing a claim. you can pursue wrongful termination issues in civil court.
if benefits are denied you can file an appeal with your work comp commission. for more information

Hi Lilly. When I went to the ER they gave a mandatory drug test. It came back negative. But I did tell my employer id taken a pain reliever the day of the accident. The company policy is what they refered me to when they fired me.

yes there are many such detailed information sites but without knowing the jurisdiction none of them will be read by those they can help the most.
