Can you still get WC medical benefits if you signed a refusal of medical treatment at the time of the accident (I'm in Texas)?
I'm not sure, but I think that's why they had you sign a refusal at that time, so that you would not be able to. Someone else with more knowledge will be along soon.
I think he might be talking about a refusal like with the fire department or ambulance. Those are used by those agencys to show that they showed up and offered treatment but you didn't want it at that time. It just protects them from you coming back and saying they didn't help you. You could sign that and two min's later ask for treatment and it would be provided. Now how that would play with WC I'm not sure. I would think as long as there was not a long time lapse between injury and now wanting treatment it shouldn't be a big problem. People that get in things like car accidents sign these refusals all the time and then go to the hospital later that day or the next for treatment. After they get home and decide maybe they are hurting more then they first though. Hope that helps.
yes you can still file a work comp claim and receive all the benefits including medical treatment.
i don't know, at the time of my injury they (my employer) took me to the dr, so they could do a drug screening. they said if it was positive they wouldn't have to cover it. so if thats the reason you refused than that could come into play. good luck, welcome to the forum and hope you get the treatment you need.
They did take me to the doctor and did a drug and alcohol screen and it was negative. But I felt fine at the time and was not in pain (this happened Monday). By the next day, I can't hardly stand the pain. They fired me the next day (Tuesday), so I don't have insurance to be ale to go to the doctor.
Speak to an lawyer right away. They should have to cover this

I have not filed a claim yet. I am trying to find out if I can since I signed a refusal of medical treatment (with the company not a doctor or facility).
