Hello everyone,

I have a question. I received a check in the mail for partial permanent disability. It is payments from Oct. 7th through March the 13th. I did have my rating done by an AME in Feb. My question is how long will I receive permanent partial disability and how is it calculated?

I spoke to my lawyer a week prior to receiving the check and he went over the AME report with me and the disability rating. He also talked about keeping the medical open but no settlement amount. My whole person impairment rating is 25%.

I saw the WC doctor a few days ago and he put me at permanent and stationary. He stated, that he would review and add to the AME's report. The WC doctor put my restrictions at 4 hour shifts with no heavy lifting or overhead work. The AME put my restrictions, no heavy lifting and prolonged repetitive neck movements.
I know different states are different, but in VA, the rating % is equal to the no. of weeks you will get your check for. So, your checks would last for 25 weeks, if your state works in the same way. Would March 13 - Oct. 7th come out to that amount of time? Just a though?

Jimmy, I'm Sorry I'm not Familiar with Ca. Laws, but I'm Sure Someone will be along to Help Soon. The Weekends are Sometimes slow with Replies!Wink
they are making advances on your permanent disability. since you have an atty and a fee will have to be deducted they will likely advance 75%-85% of the reasonable minimum PD you're likely to be awarded by the court.
Ratings are complicated and done by the rating bureau. you can find out more here
