I have recently missed sometime at work due to a knee injury and upon my arrival back my employer informed me that I would not get my scheduled raise because i missed time at work due to my injury. It this leagal for my company to do? Any info would be greatly appericated.
Hi Jdawg,
What state are you from & welcome to the forum !
Was your knee injury work related??
I am from california. Yes the knee injury was work related and I had to have it operated on 2 times in the last 8 months.
Sorry I don't know the laws for your state but are you coverd by a union at work? MY guess is they are right in not giving you the raise if it is based on time on the job. Not fair but nothing with WC is fair to the worker. Might be something you will have to work out with a lawyer now or if you settle your case. If the only thing your employer is doing is holding up a raise I would say you are lucky. I know you may not feel that way but if you read the forums you will find many of us are fighting for allot more.
Do you have an employees's handbook?
It should outline how a raise is given.
Thats not the only thing I have been dealing with just the only thing I have not been able to find out if is leagally wrong to be denied my raise at the time they are given because of my injury and time missed from it. Does any one know a website where I can read and look at the workmans comp laws for my state. That would be greatly apperiacter so I can try to locate this info. I am also curious because I work for a nationwide company and wanted to stop this from happening to anyone else.
