Hi

ic is talking settlement. i live in pa and not sure what to settle for and if i should settle. my weekly check is the max at 780.
i have been on w/c for 2 years and have reached mmi.
my income before my injury was $1400 per week. how do they come up with an amount?

I am not from Pa. so I am not sure...but here in Okla they take your rating...mine was 77% ....500 weeks is the max they pay here....so it was 77% of 500 ..........which was 405 times my weekly check to get a figure ....There are alot here from PA. so someone will be along to help you out better than me...

Laurie, I'm from Pa. also, and so is Mr. Belt, whose is an Attorney that Deals in w/c and comes on at Times and is Kind Enough to give Us Advice! I am not Sure of Your Injuries, and how Severe they are, so it is Very Hard to Answer Your Question, but I can give You a Brief Idea of how it Works. One Good Thing about Settlement in Pa. is that You can Negotiate Your Settlement Amount, Amounts aren't set in Stone Based on Disability Rating, etc., although everything about Your Case such as Age, Medical Restrictions, Disability Rating, etc. are Considered when coming Up with a Figure. There is what Is Called a "Glass Ceiling", in other Words from Past Settlements History a Certain Amount that the i/c's would be Willing to Pay Based on the Items Mentioned Above is Used, but that Ceiling has been known to Be Cracked, or even Broken at Times, but it's Rare. You can Leave Your Medical Open, or You can Close Out Your Entire Case Monetary and Medical by Entering in a Compromise and Release Settlement. Before Any Settlements can be Finalized, a w/c Judge has to Sign Off on the Agreement, and will only do so After a Hearing to be Sure that both Sides Understand and Agree on the Terms. I would Strongly Suggest that You seek Counsel to Help You through this Process, it's Pretty Complicated, and My Opinion Only, unless this is just going to be a Very Small Settlement, You should have an Attorney that Deals in w/c n Your Side to Protect Your Rights.
