Hello we are an small-not for profit organization and we pay an officer that works part time that is part of the company. Can we apply for the following category:
One or two corporate officers who either singly or jointly own all of the stock and hold all of the offices of a corporation that employs no other employees.
Thank you so much for your help

What state are you based in? Laws vary from state to state and we would need that info.

State of New York
New York has no numerical exemptions.

Executive exclusion is not in the catagory of a numerical exception.
You should contact a local insurance broker with information about corporate ownership.
Yes, but we do not have enough information to assume that. In New York All corporate officers if the corporation has more than two officers and/or two stockholders must be covered by WC. If it is an organization with other individuals in employment, Officers of one-or-two person corporations may choose to exclude themselves from coverage. Of course, NY also signifies that "most workers compensated by a nonprofit organization" must be covered.
Here is the statutory text: The term "employee" shall not include …an executive officer of a corporation who at all times during the period involved owns all of the issued and outstanding stock of the corporation and holds all of the offices pursuant to paragraph (e) of section seven hundred fifteen of the business corporation law or two executive officers of a corporation who at all times during the period involved between them own all of the issued and outstanding stock of such corporation and hold all such offices except as provided in subdivision six of section fifty-four of this chapter provided, however, that where there are two executive officers of a corporation each officer must own at least one share of stock, nor shall it include a self-employed person or a partner of a partnership as defined in section ten of the partnership law who is not covered under a compensation insurance contract or a certificate of self-insurance as provided in subdivision eight of section fifty-four of this chapter, …
Always safer to cover the employee, but if the corp officer is one of two and acting within the scope of their officer position, then you are probably ok to exempt them.
And 1171, you spelled "category" wrong....

mmmmmmmmmmmmmmmm you are in troublemmmmmmmmmmmROFLMAO
But if is a not for profit organization based in NY. Maybe it is not possible to get exempt? That is my concern.
