Hi all, New to this forum. I am on WC (IL) broke my metarsals on left foot. Had a customer drop something on it the 11th od Jan. I have an attorney(WC) Problem is they just now informed me that I had to fill out this FMLA stuff. Got to wait till Tuesday for my docs appt. He put on the ins info unknown to return to work and unknown to return full time. Probably will go back on light duty??????? Because the killer of it is I just got back not even a month from having surgery on my left foot.( WM) already started playing games with me.

FMLA has nothing to do with WC, but more of a employer/employee issue, and it's a normal thing. FMLA and WC can run together. But, it won't reflect your WC issue of injury.

You say your having problems. It be better to know them.

Well not so much right now with WC, but managers running off their mouth about how I am going to get fired, when I am off WC.

and you just might FMLA will protect your job for awhile then they can let you go...they do not(in most states) have to hold your job for you beyond FMLA regulations
Some managers are just jerks. They may be tring to get you to flare up so they can fire you. Just let it go for now. If you can, obtain witnesses, with written reports and get them to sign it, when the managers does these things. That's about all you can do.

What type work do you do?
sales associate lifting pushing carts freight when we get it etc
Also want to add to my last post. I just had surgery Sept. 30th on my left foot for my first three toes. Was back maybe a month when my injury happened. Do you think they will try to fight my case because of my previous foot problems. Our floors are solid concrete and walking on them 8 hrs a day gave me hammertoes , bunions and so on. The dr is keeping off of work , been almost five weeks, he put unknown as to when i can return or return full time.
I wouldn't be so quick to blame concrete floors for Hammer Toes;

Hammer toe most frequently results from wearing poorly-fit shoes that can force the toe into a bent position, such as excessively high heels or shoes that are too short or narrow for the foot. Having the toes bent for long periods of time can cause the muscles in them to shorten, resulting in the hammer toe deformity. This is often found in conjunction with bunions or other foot problems. It can also be caused by muscle, nerve, or joint damage resulting from conditions such as osteoarthritis, rheumatoid arthritis, stroke, Charcot-Marie-Tooth disease or diabetes
I am trying to understand what you are saying...... You had surgery not WC related and upon returning to work someone droped something on the foot you had surgery on, and now you have a WC injury. Is that correct?

WC and FMLA can run together. FMLA is a no wage federal program that protects your job for 12 weeks...........

Yes that is correct. Was back to work Dec 2nd. And Jan 11 that happened. As far as the floors , yes they do damage to your feet if you r on them alot. But that was not the point I was trying to make. I am just worried that they are going to throw in the surgery part and try to blame iton that. had to change my name on this board too.
