Does anyone know the statute (sp) of limitations on an incident report that is now an acciident? Quick info on situation: Incident report in Feb 2008, due to new job position, in same company, shoulder has went from a minor pain to not being able to lift arm above shoulder. Filled out accident report referencing previous incident to enable me to go to doc. on Nov 23 2009. WC is saying that I may not be covered at this time.

The link posted will give you the info. You may also want to read 440.185, 1 (B).
For injuries after 1/1/1994, an employee must file a claim for workers' compensation benefits within two years "after the date on which the employee knew or should have known that the injury or death arose out of work performed in the course and scope of employment." (usually the date of accident) or one year after the last date of received benefits or their right to claim benefits ends forever.

So, If your accident was in Feb 2008, and you filled out an incident report, the statute does not run until Feb 2010. They may be trying to deny based on late reporting (30 days after the injury) however, you did report to your employer at the time it happened. The IC may not be aware of that.
