hi,
i have a real mess...i live in alaska, got hurt in iowa. I was asked to lead morning exercises. i had never done that. i dont exercise. i lead a group of 15 thru about 20 exercises using a poster board guide..

i felt a little discomfort that day and took some aspirin from the nurse at work...

the next morning i went to make up my bed and could not stand up straight due to pain in my SI joint..

went on back to work but told the nurse and everyone there that i did it making up my bed...not realizing it was from the exercises..

i went to the doctor and he gave me pain meds...have not been back since..

filed a claim yesterday and hired a lwayer today..

lawyer says, they may be liable even if i did it at my hotel...i was on per diem and staying in hotel..

i am sure this happened at work...i am worried that i waited too long to say that i thought it was work related. sent in injury report to employer last week..

i was manager at work...they were very upset about all the lost time accidents and made you afraid to report...once i did i was fired..

alaska docs wont take out of state worker comp...dont want to run up med bills then have ins co doc say not work related leaving me bankrupt..

what should i do?

If I was injured, I would want to know what is going on.

From what I have read from some states (WC is state specific) They do have some things in common. One of which is a clock (time frame) in which someone needs to file by. A common phrase that I have seen is "when you were injured at work or when you knew that you were injured at work".

You said that you have employed an attorney. Fine, what has the attorney said about you seeking medical attention???? I can only assume that he/she said to seek medical attention and tell the dr. that the injury is work related.

Once you have informed a dr. that an injury is work related. the DR. then makes an assestment as to whether or not the injury could be work related.

yeah i am talking about iowa...you have 90 days...i told the employer a day after...but i thought i did it off site...now i am sure i did it while at work..

cant get a doctor up here without cash...ak docs wont take out of state wc..

i only spoke to the attorney today...waiting on retainer paperwork..

back is hurting bad but no cash and cant use private health ins for work injury..

any ideas?

will i be able to prove it was work related?

The attorney will find you a dr.. For without a dr. you don't have a case. Hence, the attorney will not get payed.

I back injury can be very serious or very minor. Some of us here are living proof.

I recall when I hurt my back. I used my personal health insurance at first. I thought it was something minor. I wound up in the hospital and had emergency surgery. WC payed for my surgey and those that followed. When I received bills from my personal IC. I sent them to WC. I also called my personal IC and advised them that the injury was work related. WC. then payed my personal IC for the services I received.

Will you be able to prove the injury is work related. That I do not know. Were you doing something off the clock that could have injured your back????? If not, then the next question is. What caused the injury??????

This needs investigating a little bit more concerning your employer. You said you live in Alaska. Is the employer you work for based in Alaska? Or did you move their after the workplace accident? This can have some bearing on which state you should file your claim in.

i live in alaska, the job was in iowa, and the company is located in massachucettes..

do i file the workmans comp claim?

if the ins co controverts the claim, i wont get any funds until the wc board reverses that?
