I went to an IME back on Nov. 10th. The following day I had a discogram with CT scan. The discogram and CT confirmed my pain and that I also had a herniation which was thought to be just a bulge before. Question I have is can an IME doctor who is a Neurologist reduce my payments when the doctor who originally put me out on full weekly benefits is a Neurosurgeon?
I'm asking this because to date I am still getting my full 400.00 here in NY. 400 because my injury was in 2005. The IC which I spoke to a couple of days ago mentioned that she was still going to pay me my full amount providing she gets the request from my surgeon for surgery (which they haven't received yet). So is she being nice or are their hands tied with reducing my payments?

Typically the IC requests an IME so they can reduce you payments. Once the IME report is filed with a request to modify or stop payments they will either be lowered or remain the same. It will depend on what the IME report says. Have you received a copy of it yet? Or received a notice that the carrier is requesting to modify or stop your payments? If it happens to request to lower the payments you can always get a new report filed by your Dr stating his opinion . Its all a matter of who has what report in last . Another game you have to contend with. As far as adjusters for the IC go, I wouldnt trust a thing that comes out of thier mouth. Remember, THEY work for the IC. The IC's main goal is to screw you out of as much money as possible. Sher

I was sent to the IME to see if my upcoming surgery is justified which my surgeon said I needed . I went to the IME on the 10th of November and my discogram and CT scan was on the 11th. While at the IME the doc never viewed my MRI CD but rather just went with the written report. My surgeon while viewing the MRI stated the findings were not accurate in the written report.

I went to an IME on Dec 1st and much to the dismay of the IC, the IME gave me more of a disability than my own Dr. Score one for the little guy.The day after I got a copy of the report, My atty e-mailed and asked if I was ready to settle.I was injured on 4/10/2008 but this has been the worst few months of my life dealing with people.Thank GOD it is almost over.
njured on 4/10/08 and ready to settle? You must have a simple injury. Most take allot longer then that. I was injuried in 11/05 and will not even be thinking about that for sometime to come

I had 3 Abdominal wall hernias, one wich caused a strangulation of the bowel.I was in the hospital for a week to relieve the strangulation and then a month later had hernia repair with goretex mesh. A month later I developed an abcess at one of the hernia sites and had another surgery to remove that piece of goretex.My Dr., The IC Dr. and the IME all agree that I am at MMI and cannot lift more than 10 lbs, no repetetive bending or squatting.After all that I have read on this forum I do feel fortunate to be getting out of this system quickly.

I was injured in June 2002 and had my permanancy hearing in Aug 2008. I will continue to fight with the insurance company the rest of my life because i refuse to settle for pennies on the dollar.
