maybe too terse. I live in a state whose comp system is vastly different than the majoritys so have no idea how anothers might work.

I have been in discussions of malpractice in comp cases when there is a poor outcome and it's a difficult thershold to reach.
My states WC is also very different. But this isn't about malpractice in WC. It's about errors that were made in the surgery on my neck. Stuff that was done wrong and stuff that shouldn't have been done at all.
Hi Stiff, I Hope You are Well Today!! If You feel Your Surgery was Erred to the Point of Malpractice, then I See no Reason You shouldn't Pursue a Law Suit. Just be Sure when Picking an Attorney how the Fees and Costs are going to be Paid, Some of these Cases can take a Very Long Time to Close. Fees and Costs can be Very Expensive if You have to Pay Up-Front, if You Win You will be Awarded the Fees and Costs Back, but as I Mentioned it can take a while to Happen! If Your Attorney is willing to Handle the Fees Upfront, they Probably Feel they have a Good Case, and that would be a Great Thing for You!! I Surely Hope the Best should You go this Route, if the Dr. You had is Incompetent in Their Duties, they should be Held Accountable!! Wink

When I read this I admit it sounded worse the first times reading them. I truly thought you were just sticking up for WC and was more less cutting down Stiffnecked. I may have took your impression wrong and I appolagize. It was just that stiff was saying somthing and you seem to be shutting him down.

Like I said again I'M a newbie sometimes I see things different and open my big mouth. I am in the dog house all the time and pretty soon the wife is going to put me on a chocker chain.

well no, I was just curious more on the stated response by his atty referencing other IWs/ attys history with this surgeon. The thought being if that was the case then it would be unlikely the surgeon had a history of leaving sponges in or operating on the wrong part, etc, clear cut actionable events of failure to meet an acceptable standard of care, but rather a series of poor outcomes where perhaps clinical judgement in selection of cases or poor technical abilities leads to a claim of incompetance rather than malpractice.

This ties into the question about state directed providers or out of panel Drs since it's not in the best interest of the employer to prefer a "butcher" ( and how and by who is that determined ?) over the highly competent since that can only increase costs and losses.

I'm not defending any particular stakeholder but do admit to a slightly different perspective than many.

Wow that is a coincidence you called a lawyer who already has medical malpractice cases started against the same doctor. I think that really helps your case though and something must be going wrong. This doctor should not be practicing anymore.
