I Believe it would be Unemployment, being as You are Working and Well. Depending on How Your State Views Ongoing Medical Care from an Injury would be the Next Area to Research. I'm in Pa., and unless I Sign a Compromise and Release Form Signing My Future Medical away, My Injury and any Complications thereof are Covered for Life, even if the Employer and the Ins. Co. were to Fold. The State would then take Over My Medical Benefits. You need to Research how Your State handles Yours. Please let Us know what You Find Out!!
Cycler & Still in Limbo .
I like to hear both sides as it does give me options to think about. I think that's what makes this forum good- as we know I can only make my fate. But the information guides the path. Thanks.
when you have FCE done have it done by a different company. I had the first one done by the company that I had been sent to do the PT and when it was done by another company it came back different. I was not happy with the results as it showed that I could not go back to the kind of work I had spent 25 years doing, but it showed there was alot more problems that had not been addressed. Also showed that I was 75% perm disabled.
Still In Limbo
Thank you for your post, it does explain some things for me that I did not understand.
In 07 my employer setup a meeting involving HR and myself. I was offered a job in the Infant/Toddler Classroom at the Early CHildhood Center where I worked as a teacher.
This sounds like a good thinkg but I walk with a cane fo help with mobility, would you want me caring for your infant or toddler in the classroom?
I was also given 3 forms for my doctor to complete. My job requires for accreditation and licensing purposes I pass health assestments, and physicals from 3 different agencies.
My doctor took one look at the forms and laughed, he marked failed on all the paper work, I have been on medical leave for 3 years.
A former coworker told me my employer wanted to return me to my job so I could be fired.
I am an example of one injured and had to change my career. I worked 15 yrs. as a phlebotomist and injured my dominant hand and knew I could no longer trust myself to hold a needle, open a sterile pack and put on gloves all day. It is very difficult to use my hand and I am afraid of dropping things and no control over my hand. You are not forced to keep the job you have. You can move onto a type of job where you think you could stay within your restrictions. I found that the job I do now is within my restrictions and luckily I am making almost twice as much as I was before in my other career.
Sometimes a change can be good for people. I know it is not like that in every case, but can happen for the better. Remember to take care of yourself as you are the one that knows what you can and cannot handle. Do not go out of your restrictions and at least give it a try to go back. I was told from my doctor a few weeks ago that there is a small percentage of people that end up going back to work after an injury and that I am very lucky to be able to go back to work. I agree and hope I can continue to work as I am 40 hours a week. It is very difficult and I fight everyday to make it through another work day. Good luck in going back and do not overdo yourself : )
My turn for my 2 cents worth.
I have had FCE's done, as I progessed though PT. It was a way to see if progress was being made. I didn't like the results of just a human making a judgement call and decission on how I might be able to work in the work field.
It was then, I went out, and paid for my own FCE to be performed. I would say all the FCE's I had, that the Computer Operated FCE's would then be the best. You remove the thoughts from what a human may think you can do. While the computer operated one has all these knowledge base opinions set-up to only allow a proper none human opinion.
When you pay for your own Computer FCE, you tell them the type work you were doing. But, you demand a full scale FCE to show what work field you now best fit into. Meaning an FCE that is not based on what you use to do only. You do it all, and the results are truely amazingly better. My computer operated FCE report was 45 pages long, in full detail, and showing how I fit in the work field, what type work I might possibly do, and how many hows per day I might be able to do what. A regular human operated FCE report was only maybe 7 pages long, and didn't show the results of everthing I tried, what problems I was having with certain things and so on.
When the Insurance Carriers do FCE's, their only based on the type work you were during when injured. That to me isn't a good full FCE. Get your moneys worth, and pay for a computer operated FCE.
Thanks again everyone, and I must say today I am more relaxed. Today I found out my lawyer takes phone calls and after talking his ear off he had made things more clear.
Bad Boy, Right on the money. He also says if he dont like the fce results he would set up to get computer one. We talked about past employment 15 years with current employer, 8 years on and off logging. And 5 years as a grounds keeper which dutties were from changing a light bulb to digging ditches. In which he says I have to keep in mind if I cant do current job I will never go back to anything I have done in the past.
He had mentioned DVR programs. He says if I go back to keep intouch with doc and employer on how I feel. And weather it hurts a little or hurts alot I am to get checked.
I want to thank every one again for the help. Bronco.
Where can you get a computer FCE done? I never heard of that and find it very interesting and curious where one can be done for my daughter that is now currently took out of work due to her medical condition. We live in NH.
I dont know my self lawyer didnt say, but bad boy might know.
Both of My FCE's were Computerized, and My PM Dr. had the Equipment Installed in Their Pittsburgh Office, but the Equipment and the Tests were Owned and Performed by a Non-Biased Co., as they did Testing for Other Dr.'s Offices and Employers also. The Equipment was there as an Convenience for Their Clients, but They did not Perform the Tests. Both Of Mine, Months Apart were the Same, or with Little Difference, and the Defense couldn't Argue it because they Used the Same Co. as My Test were Performed by.I would Never Trust an FCE without the Computer System, they have to be Calibrated each Time they are Used for Accuracy. They even Tried a Trick on the Paperwork, One of the Questions was something like: During an 8 Hour Work Day, how Many Hours do You Think You could Stand, Sit, or Stoop? Now if You Answer any of that Question, You are Implying that You can Work an 8 Hour Day, and Believe it or not, they will try and Use that Against You if You have to go to Hearings! I Answered that I cannot Perform an 8 Hour Work Day, so My Answers would Only be a Guess, and I Prefer not to Answer! Afterwards I Told My Attorney about this, and He said that was the Correct Answer, and it's a Shame that they would try and Trick You that Way! So Be Careful on any Answers You Give, Keep them Honest, but don't Allow them anything to Use against You Later!! I know this Sounds Paranoid, but it's a Shame it's True!!!
And By The Way Bummer, You're Quite Welcome!!
