Full Version: do medical providers have to assert a lien?

Let me begin by saying this is a NC case. The patient went through a lawyer to get their w/c case accepted. Before it went that far our office filed medical bills with the patients insurance, then workers comp insurance, and finally with the law office.

the law office paralegal said that claim was still begin litigated. I spoke with the actual lawyer recently and he says the case settled out of court months ago and that as a medical provider, if we didnt assert a lien that we arent entitled to any reimbursement for services.

is that legal and what recourse to we have if any?

If the case was not accepted by workers comp I would think the health carrier was still liable.
In my case which is odd when my claim was denied my persoanl health insurance did not put a lien on my claim which they should have done. 14 months later a Judge decided in my behalf and the treating Ortho ended up being paid by my personal insurance, WC and about $400 out of my pocket in the way of co-pays. It has been 18 months since they have been paid by all and still have not refunded the money to me or my persoanl health insurance co. I have reported them and I guess time will tell. I know this is different from what you asked I guess I just wanted to let you know that a liev in the norm at least in my state it is.
