Treading water here. Everyone seems to be waiting for someone else to do something. And in the meantime-no income!
Basic info here: On-the-job injury, October 2006. Various treatments/ two surgeries later treating doctor gave me permanent "restrictions". Temp disability payments stopped a month ago. QME waiting for medical reports (for a month now). No idea of status at my job (no modified work last report/ let go???)
I was told that I could file for unemployment (but I have never been officially let go?) and workers comp would have to pay unemp. people back. I just need to know what I could/should be doing. I doubt very much that I will be able to go back to my original kind of work. How/when might I find out about vocational rehabilitation?
First off what state are you in? Second do you have a lawyer? What kind of injury is it? Are you at MMI? There is alot more info. needed in order to answer your questions. Someone else will be along to help you. I just thought I would let you know to at least put that information on here for them to help you more.
each state has different comp laws and benefits.
Generally if you are permanently restricted from your former employment and the employer has/can not made an accommodation then you are no longer employed there and therefore eligible for unemployment.
Generally there is no bar to receiving unempoyment and permanent impairment benefits so I don't understand why workers comp would reimburse unemployment. But then again each state has different laws and rules.
Rehabilitation benefits vary with each state.
Until we know your state you should try looking around your state's website for workers comp and vocational rehabilitation information.

[A]I am in California. Yes, my treating physician has shown me as MMI.
No, I don't have a lawyer. I believe that my "possible" permanent disability will be rated at a very low percentage. QME is still waiting for Med. records to make % determination. He has question marks on his report as to % and vocational rehabilitation. I thought though that SOME kind on compensation would still be coming. I've managed to keep my credit okay...so far. Doesn't my employer have to do anything to inform me as to whether I'm still employed or not? I thought you had to "employable" to get unemployment?[/b]
