In California, if a claim is denied because a patient fails to submit the DWC form or fails to attend the QME, who is responsible for payment of the bills?
it depends.
if service is within the first 90 days while claim is being investigated then the carrier is still obligated.
If benefits are being denied and there's litigation then a lien can be filed.
If there's no appeal to the denial then regular health or injured should pay for non-industrial treatment.
Do you have this in writing?
