Indiana has a Cap Law and Rules set in place. Being so, I do think, and I did say I think, for I'm not 100% on this, but it might be a better question to ask an Attorney. For if the Cap rule is set in place, as I seen in about 3 other cases in your State, it didn't matter much what was written.

In Indiana, had I only heard this before, it was a injured friend, had proir L5 - S1 surgery with fusion about 4 or 5 years prior to their next injury to L4 - L5. You know they said the IC would not allow the surgeon to perform the revision to L5-S1 while doing the Fusion on L4 -L5. It was needed but not allowed. I thought the person was crazy, but, he was being treated by my surgeon. I had asked my surgeon if that was true. The surgeon can't tell you about somes case but did say, be glad you were injured in Illinois. He went on to say, Indiana is that way, and it's the Work comp is in Indiana.

Also, I think you have only 90 days to dispute a rating. After 90 days your out of the box to do so.

Here is some information on Indiana W/C Ratings.
