Full Version: Insurance company trying to declare me at MMI

My attorney shared with me today that the purpose of the IME later this month is because the insurance company intends for me to be declared MMI by their doctor.

Their doctor is an orthopedic surgeon, not a bone joint doctor.

My surgeon does not plan to place me at MMI until June 09.

My attorney says we will go to court and fight this latest devepolment.

Has anyone had this happen to them?

I have been informed that the insurance company’s goal is to place an injured worker at MMI as soon as possible is so they can stop TTD payments.

I am not worried about the TTD payments stopping, my concern is the medical treatment will stop. I have struggled with this replacement, with scar tissue and other medical problems, and I realize future medical treatment after my knee replacement is crucial.

I hope you get lucky with the IME. I had 2 of them done by the same Dr, about 7 months apart. Each time he went against my Drs. and tried to declare me completely healed and could return to my regular job. The first one was back in July,07 and the IC stopped my TPD and my meds, that's when I got a lawyer involved.
I still keep you on my prayer list, I wish you the best. Fight,fight,fight. You deserve the medical treatments to continue.

Well, I think if that happens, like I said if it happens, your Attorney has a handle on it. It seems your Attorney is looking out for your best interest. Being so, I wouldn't worry much about it.

Sure the IC will try to get a doctor to say your at MMI for the knee, but once the other issues get approved, you won't need to worry again.

Bummer this happened to me recently. The IME sent me back to work with no restrictions, put me obviously at MMI AND immediately the IC filed a petition to stop all benefits. My attorney appealed it and I won. WHile waiting for a decition no benefits were stopped. I can't remember the exact words for this petitions but Limbo and BB both know them . They helped me soooooooooooooooo much. You will be fine. Your Dr. and Attorney have alot to do here. You're not alone in this and as long as your attorney fights back you wil be fine. Try not to worry.

The IME is Friday, Oct. 24th and I go to court 30th, the following Thursday to include the back in my claim.

I expected the insurance company to be unhappy when my surgeon made the decision not to place me at MMI for another 9 months.

What I don't understand is how can an orthopedic surgeon have more value in court then the bone joint surgeon that did the replacement?

The IME doctor I am being sent to is my former wc doctor that sent me to the surgeon because and I quote, "You need to see a bone joint doctor that does knee replacements, they are not my speciality."

My attorney is a fighter and so am I. He is already talking about filing a petition if needed.

When you returned to work how long did you work? I do remember this happening, just not the details.

Attorney want to add the back and carpal tunnel to the claim, Don't know if this will happen at the same time.

You have so many medical issues, I don't see how they could place you at MMI.

I am not to worried about my employer working me, my supervisor told me as long as I have any restrictions they will not work me.

Bummer, I didn't need to be placed at MMI, for my knee was never made into a work comp claim. So I didn't need to worry about it.

Bummer, there is something you need to understand. I don't want to be the one telling you this, but I want you to just prepair for the future some. You know you have a good Attorney working in your best interest. But, you also know there is more other parts of your body that need medical attention. The fact of the matter is, your current restrictions, do reflect the other body parts, and mostly will continue too, once they are addressed and taken care of. That is all in the time it takes your Attorney to get them added on. Prepairing to know, you aren't returning to your current employement is a major must for you now. I hate telling people that. But I read what you wrote of your job requirements. Somewhere in the back of your mind, I think you knew this. Just like I did, but still I wanted to keep that line of hope open thinking someday I may return to work, doing what I use too. It took me a long time, and years to get it straight in my head. The fact of this is, your health has to come before your work now. This is going to take time, with approvals, and medical treatment. Your other issues, are still a year or better in the works, with treatment and all.

It's time to think only of you right now, your health, your well being, your healing, and just getting better to the best you can be. This is the important issue now. Now returning to work later, or returning to work, has to be placed on the back burner.

I care for you a whole heck of alot, and only a friend can sit here and talk to you like this. That is what friends are truely for, is to be there with you, every step of the way. This isn't a shocker to you as much as it may seem. Just like me, and now you, it's just something we don't want to hear or read.

I understand whatyou are saying. At my last doctor's appointment my doctor lectured me on the same issue.

I was enrolled in a college class with the goal of returning to work, and things just weren't working. No sleep, constant pain, couldn't concentrate, not getting my home work done, I wasn't doing the 4.0 work I am use to doing. I ended up having to drop the class, and was tell my doctor about the experience.

My doctor just looked at me, his eyes got big and he said, " And why do you think you can go to school right now, you can't do the work".

I have always been an independent soul, went to work at age 14 washing dishes then waitressing and paid for my high school education.

You are right, it is hard to accept.
Bummer, the end of the world isn't happening. Your strong enough to know, when you will be able to perform some kind of work, and then you take on what you can then do. I know you can do it...
