I am in middle management with a fairly large retail corporation in Texas. We have an employee that has been out on Workman's Comp for a back injury (lifting injury) since Feb. 2007. I recently discovered that this individual is still on the store payroll receiving a check of gross pay of $13.00 (thirteen dollars) per week. This has to be approved by the store manager, and I am assuming that they are still on the payroll to receive company benefits. Also, this individual and the store manager are friends. This employee has been accused of questionable actions with funds at around the time they went out on Worker's Comp.
Not the fratanization, but is the rest of this legal? If not, what do I need to do? I feel my job will be in question if I do take this to any higher level of management, as the store manager is considered completely accountable for store operations by district manager.

you might want to check into it may be vacation pay taken an hour or two a week to keep benifits in place...Pepsi did this for my husband for 6 months.....it was done thru the union...are you wanting the managers job or just dont care for the employee out on wc? Back injuries are just as painful as an open blood and gore wound just not as visual.....
Is the store manager over you or under you? I am not sure with your description of "middle management". Also, since you are in Texas, is your company a non-subscriber? If certainly sounds like the intent would be to keep them active on the payroll. Does your company have a policy of termination of inactives after a set time?
Answers to these questions would probably make it easier to give you an opinion. There are two definite red flags that you mentioned, however. If the employee and supervisor are friends, it is quite possible that this is something "outside policy" for the company. The other MAJOR red flag is that the employee had been accused of mishandling funds just prior to claiming a soft tissue injury. That should trigger suspicion if the insuror is aware of it. But if the reporting supervisor is a friend of the injured, you can bet that info did not get communicated.
Is this manager your boss, and if so, does your company have an open door policy?
or Worrkers could be looking to take someones job.....As I said because of union contract Pepsi paid My honey for one hour a week vacation time to keep him active and to maintain his senority...This in my opinion is a sign of a company who values its employees not a wrong doing....However my question is does worrkers want his managers job or have a beef with the IW and exactly why was he in the IW file and checking his payrole anyhow this seems a privacy invasion to me and he needs to have a good reason for even being in this persons file before he goes to tattle.... it could cost him his job and a invasion of privacy lawsuit
Largely thats garbage. You should be so quick to accuse injured workers. Not everyone on the other side is evil. You are assuming a lot here. What if workkers is in payroll? What if they are in HR? Then they have full rights to the info, and to question it. You did not ask for more info, you asked a question that made a clear accusation.

Not all back injurys are fake I am living ,limping proof and I had to fight 2 freaking years to get a dime...All because a co-worker said I was faking..A co -worker that was supposed to be my BEST FRIEND but saw a chance to get my job and took it..it took a lawyer and 3 court hearings and 2 very painful disc o grams to prove my injury....Yep I jumped for the worker you jumped for the man...If not for my husbands income we would have lost everything we owned just because this co worker wanted my job....I asked very good questions......why was he in this mans file? did he want the managers job? just because someone accuses you of wrong doing doesnt mean you did....he may have been cleared but the stain remained...
This guy came to the Professional and Employers Forum to ask a legitimate question, just like injured workers go to their forum and ask legitimate questions. We don't automatically accuse injured workers of fake or evil intentions, do we? He deserves no different. He should get the same respect that you expected the first time you came here to ask a question. I read the boards. You have no tolerance for anyone that is not an injured worker.

How do a woman and her husband, who both have had workers comp settlements, and both qualify for social security disability, take the time away from running their farm to do so much camping in their RV? How do they run a farm in the first place? And did I read something once about getting "the general store" back?

its easy sweet heart I was hurt and hurt bad WC after getting a good lawyer paid me very well...I bought a RV for 5 thousand dollars.....the store belonged to my daughter and SSDI oh smart one doesnt go on what you have in the bank but what you have paid in.....As far as our farm..WC also paid for it...Yes I was hurt that bad...we work it when we are having good days and it gets let go on others I have a wonderful church family,wonderful neighbors and 8 yep 8 kids to help out...to answer your next question yes I believe in birth control too bad your mother didnt....As far as 1171 she is perfectally able to fight her own battles.......sounds like you are a little bit jeolous of my life...
