Full Version: notice of IC hearing received

Okay, yesterday I got a letter from the IC board with the date of my hearing. I am in the process of obtaining an attorney. She doesn't know yet the date of my hearing. My employer rejected my claim pending an examination/second opinion from another doctor. I have yet to see their doctor. Will my hearing be postponed until this examination is completed or will the hearing proceed????
good morning well i hope not but i can tell you that i have had my hearings cancelled about 13-14 times two of them were the day before the hearing ic said because i needed more treatments done.ya and they never paid for a one of them but yet they say well you need more done before we can have a hearing on ur case.what a bunch of bull.so i would have to say yes they can cancell it because you have not had ur second opinion.or well they did that to me.they find as many reasons as they can to not have the hearing on that day or its well we need more of ur med records.just another one of there games they play.i wish you the best im just telling you my story and dont get ur hopes up.you might be able to go to that web site or ur states site and find the day and time your hearing is set for.in my state i can go to the state boards wc site and look up my hearing dates,my lawyers other hearings,and if it gets cancelled who did it.good luck my friend hope it goes well for you. The BWC site for my state (Ohio) is actually the first place that I went to and found out about the letter for hearing. It was posted on the site on 7/10/08 and I got the actual letter on 7/12/08. This is a question that I had asked my claims adjustor about before....about possible postponing of hearing without the second opinion. It sucks this being the weekend and I can't speak to my attorney until tomorrow. I am impatient....lol
Also, you mentioned about them maybe saying something along the lines of them needing more of my medical records...fortunately I don't have a very thick medical record but what there is I have managed to get a copy of ALL OF MY MEDICAL RECORDS including my pre-employment physical for my current employer. It is my understanding that copies of this information is to be provided to both parties before the hearing. My attorney will make sure that my employer/their rep. gets their copies.
I did not have a lawyer for my hearing. I got notified one month exactly to the day. Here in NH they cannot cancel the hearing within 2 weeks. I did everything on my own and wished i had time to find legal help at the last min. I should be hearing something within 30 days of how the hearing went. Halfway there waiting. GRRRRRRRRR.
Well, you're part of my reason for getting a lawyer....I've been reading everybodies posts on here and almost all of them have recommended getting an attorney. I am scared...this is new to me and while I'm confident I have plenty to plead my case I feel that I am not knowledgable enough to do it alone. Paying off an attorney scares me...but most of them will not charge you unless you win. Whats scares me most though is not getting this fixed so I can get back to work. With 2 weeks to go I'm not even sure if an attorney can help. Any advice Sparkey?

Thanks everyone. The first person I'll be talking to tomorrow morning will be my lawyer. I imagine I'll be busy with her for awhile and hopefully faxing paperwork to try and make more sense of all of this. I have to stop by hospital to get more copies of medical records...I almost forgot I had a pre-employment physical for my employer and I passed with flying colors...lol I had a thought while doing more research on my computer....carpal tunnel can be supposively be caused by hand trauma???? Does anyone have a clue what that means and are they talking about recent hand trauma or something that happened years ago? Sorry to ramble...
