I was just briefed on the job.I will have to go through training for a week then I will learn all about the job(I know enough about what they do).Then out on the job with another tech for a week.Then back in house training for a week.I will be able to perform the job because the week before the all the training starts I fianally get my epiduril and I know that will help.I will still be working in my state.The communications companys main hub is in OK.Born

I have not been offerred a job myself, but I did help my son fill out an application for a new job. It stated on it to be only filled out after a job was offerred. the questionnaire had 2 pages of information regarding prior injuries, any doctor visits, any surgeries, basically your entire life's medical history, along with doctor's name, number, and addresses. At the bottom of the form there was a disclaimer stating that the employee had given consent for such information-and also they could (and I can't remember how this was worded exactly) but that if they chose they would cross match your SSN with WC to see if you had ever filed any claims, or received benefits from WC. If you had lied on it-you are basically on your own for not reporting. Then it had minimal information regarding Subsequent Injuries. All this and wanted a credit check, background check, and drug screen as well-he's 19 and he was like what it all this?!

In Mich....they are not allowed to ask such questions...not about WC or other disabilities you may have....just like they cannot ask you about how many children you have, or if you plan on having any. Last interview I had, my interviewer was very careful on beating around the bush fishing for such info....but never actually asked me. On some of the apps you run across...you will find the statement " optional" THEN they can ask your sex or age, as you were given the choice as to if you wanted to answer them or not.
Last job I had ..our company wanted our personal medication info list ...supposedly for their files. I gave it to them as I had nothing to hide as I am a heart patient...but when we got slow my boss made a statement to me about my medication routine and possible lay off in the same sentence....so never again would I supply such info, I would lie if i had to. The reason I supplied such personal info was I was afraid if I got drawn to be drug tested....that some of my meds may give a false positive. I did argue the fact in our meeting when it was presented to all of us that I felt it was unfair...as if I had Aids, or a vaginal yeast infection, it was none of their business....but the company lawyer is the one who called us all together to tell us we needed to supply med list.

Here in Montana they are not allowed to ask questions like that and if they do you are in your right to not respond with a yes or a no. It is not lying to say "I do not feel comfortable answering that question" If they decline employment to you over that, then there is legal action you can take. My voc rehab lady encouraged me to tell them as well...I was denied well over 20 jobs after I gave them information about my precious WC injuries. Now, the problem is that I can not prove that they declined to hire me due to my injury, because they can say whatever the heck they want. So I stopped telling them of my previous personal life and was instantly offered employment and again offered employment quickly after leaving that job as well. My current boss does now know I have problems and is ok with that, but I know she would not have hired me had I told her at my interview...not because she is a bad person (because she is a very caring boss) but more because she has not had good WC/employer issues in the past and it is a liability issue for her. Is that right for her to feel that way? Probably not, but it is reality...so I personally think that it is none of the employer's business until after employment has been accepted and even then I think it is up to the employee and whether they feel comfortable sharing that info. Do you discuss whether you have been divorced or not? Or whether you lived through cancer? Or whether your dealing with personal family issues? I don't feel your personal injury should be handled any differently. Just my opinion.
Summary Note;
If there are questions asking a if you would agree to consent to what ever that question is, and it's on a Applicantion, your would be asked to if you agree, and asked to sign if you disagree.
These are becoming more and more popular and are Legal. They, the Employer isn't coming directly out asking a question, their asking if you will consent to certain Background checks. And if you sign that you agree to that, you gave consent, which is legal....
Unless I was applying for a job that somehow involved some type of security reasons (school, gov. etc) I would never sign a consent form like that to get a job...that's just me though.

I fully agree with you, but see I have seen these issue in those web links I put up, in part of booklets that were for Job Applications. I have been told, it won't be long, before they go Nation wide. Your right, I would not consent neither. But as you can view what I have been talking about, it is clearly legal.
