Full Version: An employee in on W/C w/ a 2nd job...

Hello,
We have an employee who works both with our co. and another. She is on leave with W/C on her other job and wants to come back to work (with restrictions), but is asking for more hrs. than she had prior to the injury. We have no problem taking her back with the restrictions, but are we allowed to give her more hrs. than she had prior to the injury? We want to make sure we are not doing anything wrong here. (This is in the state of VA.)

if she's not working outside her restrictions and reporting the earnings then there should be no problem.
Thank you. I will pass this on to my boss. We don't know if she has told W/C that she is back and working for us agian, but I guess as the employer, our responsibility would be to fill out the correct hrs. and tips if/when W/C asks us for the info. Is that correct?
I know when i was on light duty working 4 hours a day , 5 days a week, i had to check with the doctor first for him to give the okay for me to work more hours within my restrictions. She may need the doctor to also agree to more hours. I would say if she can handle more hours, then they should not have a problem with it.

You are more than welcome. I would just think that it should be cleared by the doctor so that there is nothing that WC can come back to her and say that she went against the policy and the doctors restrictions.

first time posting so im not sure if im typing in the right box but here goes--depending on the state- if you have 2 jobs and the companies are aware of it--your ttd payments are based on the salary from both jobs. by returning to the job that the injury did not occur at--she could be working and still be collecting w/c benefits from both jobs if she has not informed the w/c that she is returning to your company--in the end your company would be paying her double and if she wants more hours she could be making a killing if the w/c company is not informed. hate to say it but there are people out there that do these kind of things and makes the system as brutual as it is
