MrzParker Wrote:I have been searching for the ak laws regarding FMLA/WC. Reason being is when i went to file for UI. I recieved a questionaire with questions asking me why I quit my job? Thats what got me thinking, I know how this employer works. I called the Employers HR office, requested the information they based their decision on, and to submit it to me so I can be prepared for my meeting. I have yet to recieve it. My motto, right now i have nothing but time and patience. If theres one thing ive learned while working in the medical field is Documentation! If my employer was in the right, then ill accept that. But until then im gonna get the information i need to verify it. Pray for me you all. Ill keep you posted. I have a meeting with a state public advocacy group that looked into my information, contacted me right away and I meet with them 02/07/2008.
you go with the documentation!...........many on here are nurses or medical people. I was a documentation fiend! Appears it will serve me well now that i'm an i/w..................and you're right i've got the time and the patience as i was terminated also............................
Please update us on your meeting and how your case goes..........what we learn we can then share when others are looking for answers......................................................................
you've got my prayers!
Hi everyone,
I was injured two weeks ago, I'm new to all of this and I've been reading everyone's stories....I'm having a hard time sleeping because of my meds...it's been a bit discouraging to say the least. I feel so bad for everyone else that's already been down the path that I'm currently on but it's good to know that there are others with so much knowledge to share.
I'm going to have an MRI done this coming friday. I really don't know what's going on with the insurance company. My HR manager and I tried calling the adjuster and case manager about returning to work and they haven't responded. I get numbness on my left arm, headaches that are the result of neck and back pain, stiffness on my neck. Walking agitates everything.
I guess a part of me feels helpless right now because I want to return to work but I'm not sure if my body can handle it.
Does anyone have any suggestions?

wow, yep they can do that.. but that just makes your clm better in a sense. Generally most employers do not terminate employment while on w/c as they have more involvement with the clm etc, when the ee is working or on light duty or in your case they would be able to communicate w the ins co. It's just not fair , but I guess businesses have to of course must carry on . Good luck ?
Hello to all... I'm in CA,
I am new to this site. I got injured approximately 3 1/2 months ago. My FMLA ended 3 weeks ago and in the very begining my boss told me that even though I was going on unpaid medical leave and continuing on WC he would hold my position for me when I was released. Are they obligated by law in CA. Or am I screwed. I am very trusting...should I have him sign a paper stating it or just hold my breathe and wish for the best. I am looking at maybe returning in a month or two max.
Thanks for the help I finally feel like theres people out there that understand....

Thanks Jayne you are a kind person.
Yes, that happened to me too. They kept my FMLA open for six months. After that they gave me another six months for Medical leave (forgot what they called it). Then the doctor released me back to work with restrictions and they had no work for me based on those restrictions. However you are still considered an employee while you are recieving benefits. Back in November NYS disability cancelled my claim because I did not find a job within my restrictions fast enough and now I am no longer an employee. Nice huh?
