HI ALL,I FINISHED MY EXAM WITH THE I/C BACK SURGEON,HE PUT ME AT MMI PPI 5% AND ON SEDEMENTERY WORK WITH A 10 LB. LIFTING RESTRICTION...HOW CAN I POSSIBLY HAVE ONLY A 5% RATING WHEN THE JOB I USED TO DO, BEFORE BEING TERMINATED BECAUSE OF THIS INJURY, WAS CONSIDERED BY THE DEPARTMENT OF LABOR AS BEING "VERY HEAVY" AND I CAN NO LONGER GO BACK TO THAT SAME OCCUPATION THAT I HAVE DONE MOST OF MY LIFE.WHO IS GOING TO HIRE SOMEONE WITH A 10 LB. LIFTING RESTICTION,MY GUESS WOULD BE "NO BODY"...AND ON TOP OF THAT, THE SURGEON DOES NOT RECOMEND SURGERY AT THIS TIME...JUST FIX ME AND LET ME GO BACK TO WHAT I DO BEST,MY JOB....I KNOW THIS IS NOTHING NEW TO SOME OF YOU,HOW DID YOU HANDLE THE SITUATION AND WHAT WAS YOUR OUTCOME....HOW CAN WE PROTECT OURSELVES FROM THIS TYPE OF ERONIOUS RATINGS!!!!!
first your lawyer will get his own Doc to give a better rating...and then some of us sign up for SSDI....
Sorry to Hear of your Rating Truckster!! As you know I'm a Trucker also, and although I haven't had a Quote "Rating" Yet, I have had two FCE's and both have given me a 5lb. Rating and I'm on Heavy Narcotics!! And My Co. is still fighting me to come back to Work when SSDI Fully Disabled Me in 3mos./3Wks. Without an Attorney, and I'm Typing to you from a Wheel Chair!!! I have to go to Hearing Number 12 next Week. Who in their right Mind is going to Hire someone like Me with a 5lb. Limit, Minimal Mobility, and taking 100mcg Per Hr. Fentanyl Patches, Morphine for Breakthrough, 3000Mg. of Neurontin a Day, 150Mg. of Lyrica a Day, Promethyzine for Nausea from the Drugs, Klonopin, High Blood Pressure Meds., and Simvistatin for Cholesterol!!! Not to Mention the Testerone Therapy I'm taking because the Chronic pain has stopped My Body from Producing it!!! And before My Injury, I didn't even Take Aspirin!! Trust Me, I know Your Frustration!!! I Swear this System is sometimes trying to make us Crazy!! Just hang in there Truckster, I Wish I could come up with Words of Wisdom for You, but with the Way this System has been treating me lately, all I can Offer is Moral Support!! Best Of Luck!!!Wink
I too can only offer moral support....but I've come to think from reading all the threads here that nothing ceases to amaze me any longer....this system is a joke.....literally....sorry to hear this, but we're all here for you...

The impairment rating in your state is from the ama 5th edition. Not that it really matters. The rating has nothing to do with what you did before, or what you can do after the injury. It is based on your medical condition and the interpritation of the book. If you believe the rating is low, by all means contest it.

I received a 10% rating. When that finallized I started looking at going back to school, rehabilitation services, and applied for ssdi. I was approved for ssdi, I am applying for school grants, and hopefully will be in class in January.

I encourage you and everyone to look into every state and government agency for assistance before your benifits end. My theory is/was to open as many doors as possible, We never know which one we will need to walk through.
Oh boy am I really getting excited for my rating in a few weeks. HA! I was curious AQA what is your injury to get a 10% rating? I have carpal tunnel recurrance/tendonitis and still have not heard from anyone what they may think a rating of dominant hand/arm would be in NH. Like i said in my other post, i heard 20% automatic for dominant hand.

I am wondering in a ball park range what i can expect if anyone knows. After your rating, how do you figure your lump sum you would be receiving? Multiply the rating times the TTD payment i was receiving at the time of injury? If anyone knows, please get back to me. I do not even know closely what to expect for a rating, and if i should get a second opinion or not if it is not a good one.

Sparkey, my injury is L5-S1 with nerve damage. Texas still uses the ama 4th edition.
AQA, I have exactly the same injury as you L5-S1 and nerve damage and my rating here inIllinois was 5%, without surgery. I have never collected a penny from WC as they denied my claim for over a year, by that time my Dr released me MMI, and was teminated and decided to retire. Did collect unemployment with restrictions and no one would hire me, Age, permenent restrictions, Agreed to settle 6 months ago and still In Limbo ( no pun )
You agreed to settle six months ago and still no settlement?? I was told and read that there is like 15 days after a rating that you should receive your lump sum? Is this true? Isn't there a time limit they have?
