Going to outside sources for help good or bad ????
I will not bother going into detail again and boring everyone with my case because i see that there is an option on this site to see all my post with one click. I only posted like 3 or 4 times anyway. Here is my Question. Is it a good idea to go to a councilman or a assemblyman for help with wrong doings by the WC system or would that hurt me in the eyes of the WC judges and IC or even my own attorney having them think i went over there head ? Not like they are doing me any good now but i don't want to have them do anything to me on retaliation. The WC Judges here in New York are like babies with robes everyone is so afraid to Question them there has to be a reason. Thanks for all the responses i have received in my last post Tony !!!!!

You know, I don't know the answer to this, but I am sure if you surfed the net a bit you will find some sort of forum where you could get some more professional advice. I know that in England anything to do with solicitors also has a counterpart system to give advice and support to the people who have to go through it. There must be something like that here. What about you local universtity........the law department? They sometimes, like here in Montana, give free advice to the public. Andif youdid that you wouldn't comprimise your situation with the w/c unnessarily. God my spelling is getting awful.
I am sure there will be someone on here who can also advise. Everyone here has experience, as a whole, just about anything that the system can possibly throw at you. I wish you the very best. My heart goes out to you. It is so sad that you are having to go through all of this just to get what officially should be right.

Retaliation is what i am afraid of. Who knows how long it will take for WC to make a decision in my my case i just figured a little help might have them expedite my case. Over 8 months now and who knows when they will do anything. After all i am just a number. I guess you are right it wont do any good
tony i really dont know what to say other then do u have a lawyer? I woudl get on his tail and make him do somkething for you that is crazy did you file for ssi? U should be able to get it..good luck my friend from a fellow new yorker

hi Mel yes i do have a lawyer.Every time i put in a word search for ssi I get to there site, on the site there is a questionnaire to see if you qualify one of the question's asked is if you are disabled after all my responses are entered it comes back i qualify for ssd not ssi yea right until you apply then they turn you down. i need to call them and speak to a human being tomorrow thanks for the help also sorry to hear you are going thru this nightmare in NY it is the worse here is a little tidbit about the WCB in the state of New York :
ACCORDING TO:
The National Association of Insurance Commissioners: the average profit margin for workers' compensation to insurance companies was 14.3% as opposed to auto insurance (5.5%) and homeowners insurance (5.4%)
The Center on Worker Injury Policy, Inc.: NY places 34th in the nation for having the lowest weekly benefit rate. NY's maximum weekly benefit replaces only 53% of the state's average weekly wage which puts NY dead last in the nation.
If Governor Pataki further cuts benefits by imposing caps, we will rank among the four worst states in workers' compensation benefits to permanently (and most sriously) disabled workers.
It should be noted that although the maximum benefit in NY is $400 a week, most of us that have been seriously disabled do not get that.
It should, also, be noted that the minimum benefit rate in NY is $40 a week. The highest lump sum payment in NY was $150,000.
WORKERS' COMPENSATION NEITHER WORKS NOR COMPENSATES!!!

hi tony i know that is terrible..I think you may have misunderstood me..I no longer reside in NY way to expensive to live there i moved to NJ..And i have to say thank god i got injured here i get 70% of my weekly wage which pretty much equals to may regular pay minus insurance and taxes and i am crossing my fingers i havent had any issues with the insurance company yet lets hope i dont

Lucky you. My Wife Karla who passed away last Nov was from NJ (Oakland). I am from Queens. 70% that is pretty good i would say. Good for you Mel

oh tony im so sorry to hear about your wife wow she must have been young thats terrible..well yea i am pretty lucky i guess but let me tell you there is nothing like ny and ny city i miss it everyday
