I have recently been injured on the job and seen by the workman comp doctor that our company uses. He has placed me on light duty with a 10 lb. lifting restriction. I was informed by Administration that if I was unable to do my 'job description' then they would have to send me home. My question is, do I get compensated for not being able to work, or am I required to use my own sick leave to compensate my loss of work hours.
It depends on how long you are off work and what state you are in.
If you don't have an injury leave bank at your work, then you do need to use sick or vacation time to continue getting a pay check. If your in California, and your doctor puts you on light duty, even 10 pounds, your employer is required to make reasonable accomodations for you to stay and work. That's Federal Law! That is meant to protect you from discrimination of a dissability. It's when your doctor says you can't to the job anymore that you need to be concerned about. I hope it all works out. Exactly what Bothknees said. They are suppose to find you work at light duty. If not they may send you home for now till they can think of something. I found when i was put at light duty for 2 months i got so bad i ended up with overuse syndrome. It is not till the doctor puts you out of work that you can be out and get paid from the wc ic.
You should never have to use your sick time. I was out for 9months and never used one day of vacation or sick time. I had 12 weeks of FMLA and i do not know what they used for the rest but it was all there when i went back. I ended up giving my notice and got a new job that would not hurt me anymore and was reimbursed for my sick/vacation time. Also i did not pay one cent to my insurance co. the whole 9months i was out. Every state and every employment is different. You would need to contact your HR dept. to get info what you have to protect you.
many states pay temporary partial disability e.g. they pay a portion of lost earnings.
yes but you can be put out of work on light duty thats what happend to me they didnt have a job that fit my needs to they put me out on ttd..LOL im still wiaitng to get paid should be this week!!!
