The employers are definately aware of the civil suit. Although the suit was filed in Feb, the attorneys just had them served recently. Something I found a bit odd... The site manager who was operating the equipment who knocked over the pallet on my husband, lives on their property! I guess the have a huge house and a apartment somewhere on the property that he lives in. Not sure how long he's lived there but seems odd and unprofessional. With workman comp not even close to settling, I'm not real sure how all this is going to work. We do trust our lawyers and they are excellent at what they do. The attorney did let us know workers comp was at the last court date for the civil suit and they are aware of it. They must of expected it. I'm sure the employer did as well. All we can do now is just let it play out.
Did your husband survive the pallet being drop on him?
Yes he survive thank goodness. Hard hat save him and the fact the glass did as it should, breaking into tiny pieces but after the 3,600 lb impact.
