Full Version: Consequential Injuries and SLU in NYS

Just a quick question - My WC case for my left knee was settled in 2009 on a SLU and we finally got my right kn ee and hip included as consequential injuries. My question is regarding the SLU - if, according to what I've read a total hip replacement is 60- 66 2/3% loss of use and my right knee is 50%, do the two percentages get added together in terms of the number of weeks in calculating the SLU? In other words, my hip would be 192 weeks (66%) and my knee 144 weeks (50%) for a total of 336 weeks???
I'd appreciate it if a knowledgable NYS WC attorney could let me know.
