QUESTION: My life partner/roommate of 15 yrs. does everything for me Everything! I couldnt walk for 6 mos (both legs crushed at work). She did it all; paperwork for all agencies, all communications with attorney, doctors, PT, meds, drove, cooked, cleaned, washed, shopped, bathed, etc. Now, I've been diagnosed with Stage IV Colorectal Cancer (not related). If I die b4 I settle and if I name her in my will as my sole beneficiary can she continue with the suit?
most likely not.......however different states different rules....ask your lawyer...
the issue is not whether you are dependent upon them.
it's whether they can be considered your dependent.
there is no one answer for every state.

in california all temporary and permanent disability end upon the employees death. however accrued payments would be payable to their dependents.
