What happens if an Iw refuses deposition. I have a complicated matter ,not to go in to now, state of CA

What can they do ?
Who is they ? Issue will decided against the one who refuses ?

They would be the one requesting it. Usually an IC. Med bills are paid.
There should be no reason to refuse. If you have an attorney they help you along. What's the big deal, as it may just be a benefit to you.

You make it hard to answer as you provide a very little to comment on.

it's likely to put further litigation into suspension.
I don't like the way IW's are treated in California. Went to an AME he said he was going to side with me ( I will see ) . I was reinjured and had another surgery . PTP say no new injury no new claim, total BS

I think every injured worker in this state should fight every little thing.But of course that is not going to happen.

I find it unbelievable as to what is our rights here in CA. I figure if the IC wants a depo they can work for it .Subpeonas or whatever.

My question is what can they do if I refuse. I already have an FMC .Bills are paid .

Shadow, ever think the Depo can help your case? Such as you stated you been denied due to AME. Such Depo may help you clear this all up. Then it is a true form of fighting for your rights that you wish, and speak of.

Regardless of how Complicated Your Case is, Your Deposition is Your Time to Tell Your Side of Your Story, and how Your Injury Occurred, and how it's Work Related etc. It's a Written Record of Your Own Words as to How You were Injured, how Your Treatment is going, and how You are coming along with Your Injury. Not giving a Deposition is Like Taking the 5th at a Trial, and that Usually is not Good for the Person doing it, although it May not be the Case, but it Sure could Add Suspicion against You. You should Think this Over again in My Opinion, and Discuss it in Length with Your Attorney if You have One.

Future medical award 10 years old. Reinjure last year . Filed claim .Ic denied claim based on ptp says no new injury but need immediate surgery. Had surgery.PTP full of BS. Ame says in my favor no report yet.

The system is rigged . I am going back to work ASAP . I dont care if this goes on forever. I still have FMC .IC is liable no matter what.

No new claim = no benefits. Sate of CA Paid all TD (SDI) It is a complicated matter . Ca filed a lien they kind of want thier money back from IC. Waiting for AME report for clarification

Yes a depo may help. You are right. Like I said let it go on forever .I am released to work and looking .

I will not participate in thier Depo which I know is coming.What are thye going to do? Cant hurt you if you dont care.

Like I said I have the FMC for life .Med bills paid . I am going back to labor intensive work . Its all I know . They can keep on paying the bills .
