hello everyone Iam thankfull for all the information received
in this forum, its been very helpfull, this is my question.
IAM IN CALIFORNIA.had a back injury in june 2008.
I collected state disability while workmans comp investigated
my accident, they would not pay anything until they found out.
this was indeed a work related injury.
it took them 6 months to aprove my case.
my question is this.does workers comp have to pay me
the 104 weeks allowed in california from the time of the injury
june 2008. or they are to payme from december 2008
wich is the month they aproved my case?
still in a lot of pain after surgery, doctors say permanent disability
my only option....thanks..I know 1171 has also a lot of knowledge on this matter, would appreciate your input 1171

i would think that since you received state disability that you wouldnt worry about ttd payments bc if you get the back pay for the ttd payments you would then have to pay the state there money back..im pretty sure your not supposed to be paid twice
you win....
there was a test case on that issue in 2007
http://www.dir.ca.gov/WCAB/EnBancdecisio...7-EB-6.pdf
--the 104 week clock starts with their first TD payment to you; not from when it was owed.

P.S. pain is poorly compensated for under comp.
