Hi All,

First let me say I cleaned up the first word, not what I would of liked to say but I tend to be a polite person on the internet.

I have been waiting for a judges ruling since I went to court in Dec 2009.
My lawyer paid for me to go for an IME in February, I paid for the MRI. So last week I asked my lawyer if he could ask the judges clerk when she might make our ruling. My lawyer told me that he'd ask her if he remembered. Okay fine, fast forward to today.

Yesterday received the IME, went to talk to the lawyer this am and now I'm peeved. There will be no ruling on my case at this time. My lawyer without mentioning it to me asked for a delay. So now we're waiting on a court date so we can present medical evidence. One thing I didn't ask my lawyer about and I'm expecting a call from him any minute is this. We weren't just waiting for a ruling on care we were also waiting for ruling on TTD. So now this has been delayed AGAIN.

My previous lawyer when we went to court after I fell accidentally left out the TTD part when we filed. So when she ruled 13 months later I didn't TTD and I asked my lawyer why. Opps, sorry, we accidentally left that part out. So we filed for TTD, 6 months later she ruled for TTD in my favor. Sure it was nice getting a check for $17,000. after the lawyer took his bit but it would of been even better if we hadn't waited over 2 years for it.

So I'm mad, very mad, I think I have a right to be mad. Now we continue with the crap of my receiving no care on a limb that hurts, buckles and keeps me from enjoying life. I'm not the professional here, you need surgery sure I can help with that. But work comp law, no, my lawyer should of told me that I wouldn't of gotten a ruling. Now if I'm lucky I'll get a ruling from the judge by Christmas.

It is the same lawyer that Bummer uses, she's a bit speechless over this.

Bodybuilder, Sorry my phone lost signal when we were talking.

Bad Boy this is the same attorney I have, he has done right by me.

My sister, brother-in-law on the other side of the family & his wife all have used this attorney, all have been happy with him.

My thoughts are, the hearing was in December asking for treatment & TTD.

Bodybuilder saw the IME doctor in February which her attorney sent her to.

The attorney has asked for a delay so the IME doctor would have time to write his report. The attorney will ask for a new hearing in order to present additional medical evidence which will make for a stronger case for the knee replacement.

Frustrating for Bodybuilder because her knee is in very bad shape and she needs the replacement now, along with the TTD.
Just asking that the lawyer tell their client what might happen, if he just had told me. That's all I ask, I don't usually get upset when people tell me upfront what has to happen. Expecting a ruling and then find out it won't happen for months.

I guess I expect too much.
I would like to know the attorney's reasoning in this.

Sometimes they have to play the games to get things done in the world of wc.
I will find out tomorrow what is going on. As per our discussion on the phone this evening. I expect all of the ducks to be in a row, I like to be kept informed. If things change I expect only a call or even an email.

i dont think your asking too much BB..its your health and earnings that these ppl are messing with..and your paying this lawyer..i think you deserve to know atleast that much..hopefully you will get some answers soon
BB...sorry to hear of this... could be some explanations; however, I truly understand your frustrations. As most know on this board, waiting in Pain is not fun and then to have no income is even less fun... so talk to this lawyer and get his explanation and then do what you must. It is your life and he or she has no right to delay like this. I do know also from my husband's experience with a lawyer that not all lawyers take the time to teach the process or explain what to expect. I don't agree with it but saw it first hand. Also while they are working in your corner or so that is their oath... sometimes due to their practice they may have something up their sleeve that they will not include you in. There could be a lot of explanations but I had some of the same feelings with Del's lawyer. Also know that it took almost 6 months for Del's doc who did the IME at our lawyers recommendation and who we paid to do to complete the report so that Del and his lawyer could go to court. W/C is a mess all around. Good luck Red
