Corrections Officer Charged With Workers' Comp. Fraud

New York, NY (CompNewsNetwork) - A Genesee County man who claimed his back injury prevented him from returning to work as a corrections officer allegedly collected more than $31,000 in illegal benefits in a case of workers’ compensation fraud against the New York State Insurance Fund.

David Fetzer, 33, of Batavia, NY, faces felony charges of grand larceny, insurance fraud, offering a false instrument for filing and fraudulent practices following his arrest by state police in Rochester on February 26.

Investigators from NYSIF’s Division of Confidential Investigations (DCI) alleged that Mr. Fetzer was employed at the Billy Goat Bar in Batavia at the same time he was receiving workers’ compensation benefits for a back injury he sustained while working at the Fishkill Correctional Facility on April 9, 2008.

During this time, he allegedly returned signed statements to NYSIF indicating he had not returned to any form of work.

NYSIF DCI conducted the investigation in cooperation with the New York State Insurance Department Frauds Bureau, the Office of the Workers’ Compensation Board Fraud Inspector General and the New York State Department of Corrections.

Investigators alleged that Mr. Fetzer collected $31,052 to which he was not entitled. As a result of his arrest, NYSIF estimated potential future savings on Mr. Fetzer’s claim at $6,020.

Criminal complaints and indictments are accusations only. Defendants are innocent until proven guilty.
