NC Man Charged With Workers' Compensation Fraud

Rocky Hill, CT (CompNewsNetwork) - A former Huntington resident who now lives in North Carolina was arrested today and charged with one count of Workers' Compensation Fraud and one count of Perjury.

According to the arrest warrant affidavit, MARJAN GJURAJ, age 48, ran a heating and air conditioning business in North Carolina while collecting workers' compensation benefits for a reported work-related injury in Connecticut.

Mr. Gjuraj claimed to have been injured in a motor vehicle accident on February 27, 2007, while working as a service technician for Mazal Fuel Company of Norwalk, the warrant states.

While collecting benefits as a result of the injury, he was found to also be owner and operator of Carolina Comfort Heating and Air Conditioning Company in Charlotte, N.C., the warrant alleges.

Days after Connecticut investigators requested records detailing his income, Mr. Gjuraj agreed to pay $40,000 in restitution for the workers' compensation benefits he had received, the warrant states.

The charges against Mr. Gjurag are merely accusations, and he is presumed innocent until and unless proven guilty.

Workers' Compensation Fraud is a felony punishable by up to 20 years in prison. Perjury is a felony carrying a maximum prison term of five years.

Mr. Gjuraj will be arraigned in the Derby Superior Court, G.A. No. 5, on March 13, 2009.

The case will be prosecuted the Workers' Compensation Fraud Control Bureau of the Chief State's Attorney's Office in Rocky Hill.

I know of a case where a recipient of Workers Compensation was driving for a truck company under the table for cash without reporting the income to either OWCP or the IRS.
